Default Unpaid Condominium Fees

Hi all

I have just bought a property in Italy which i was aware that had unpaid condo fees and was informed i was liable to pay the previous two years. Jan 2008 to dec 2009 financial years. The costs were explained in detail with the administrator and i agreed to pay.

Now they have told me i also have to pay for major works that were carried out in 2007 but not paid for until Jan 2008...the administrator has apologised and said that at the time she didnt think we were liable as were approved and done in 2007 but has now changed her idea and told us we must pay. She runs different balance sheets..one for the normal everyday condominuim expenses and seperate balance sheets for extra works...obviously we have never seen this one.

Has anyone of this group had a similiar experience or anyone with any advise would be appreciated.
I wouldnt mind if they were only a few hundred but they run into the thousands.

Many thanks in advance

Regards

Hi, unfortunately you are jointly and severally liable for the unpaid sums with the previous owner. However the administrator can petition for an injunction that is immediately executive only against the current owner (you). You, on the other hand, have the possibility of then suing the previous owner (the outcome would be uncertain judging by the different decisions of the appeals courts).
Unfortunately the only way to prevent this is to make sure, before buying, that all previous condominium fees have been paid. So I think you either need to pay up or seek a lawyer to help you fight it and/or seek redress from the seller.

Sorry to here this for you . I only know the laws in Florida. But what the above said is: your f.....
If you go the attorney rout you will pay him thousand with a 50/50 chance.
If you just pay it its over and done.
