Default Buying a house in Italy

Hi, My Uncle is retiring and selling off his farm land. I have the opportunity to purchase one of the houses on the land along with a substantial olive grove which sits in front of the house for a very, very good price, around a fifth of the market value. He tells he its as simple as he has a document drafted which we both sign, I pay him and the property is mine - it can't be that simple? I trust my uncle 100% as we are very close, but do I need to get legal council? What taxes do I need to consider? I already own my own property in the UK where I live. Although I was born in the UK I have duel nationality if that helps.

Any advice would be helpful.

No it isn't that easy. You need to have the contract drafted or at the very least authenticated by an Italian notary, who needs to ascertain that your uncle is indeed the legal owner, check there are no mortgages or other charges on it, no third party rights, rights of pre-emption etc etc, then, once a valid contract "atto di compravendita" has been signed, register it contract with the land registry, effectively "publishing" the contract in the public registers.

If you are interested in buying this property then you need to make an appointment to see a notary asap, taking along all the appropriate documentation that your uncle should be able to provide (his title, land registry records etc). Taxes depend on the cadastral value of the property and land, and the notary will be able to calculate what you will pay.

It doesn't make any difference you having dual nationality but if you want to come and live in Italy in the property, you can claim a tax relief on the purchase taxes and pay a lower rate.

Thank you very much for taking the time to respond.This is good information. I plan to visit at the start of Nov so will make appropriate arrangements. I read somewhere that the tax is 10% of the cadastra value, not the fee I pay. That concerns me a bit as the value of the house and land could be in the region of €220,000. Does the fact that the land will still be used to produce olives, that is the land will still be farm land, make any difference?

I appreciate the advice as the house and land belonged to my Great Grandfather therefore has a lot of sentimental value. My Grandfather and Uncle rebuilt the house after the war so quite a bit of family history tied into it.
